Terms of Use
A clear basis for using this site.
These Terms explain what VIVO’s public website is for today, what it is not, and the ground rules for using it while VIVO remains in pre-launch.
Read the policy01
Agreement to these terms
These Terms of Use govern your access to and use of vivodelivers.com. By using the website, you agree to these Terms. If you do not agree, please do not use the site.
In these Terms, “VIVO,” “we,” “us,” and “our” mean the pre-launch local delivery business presenting the VIVO website. These Terms apply to the website and its current public content, not to a future commercial delivery platform or a future agreement that VIVO may enter into separately.
02
A pre-launch website
VIVO is building, testing, and learning before opening delivery service. The website is an informational and conversation-focused site. VIVO is not currently operating a commercial delivery platform through this website.
Nothing on the site is an offer to provide delivery services, a promise of market availability, a promise of future employment or driver work, a restaurant-service agreement, a partnership agreement, or a commitment to launch on a specific date or in a specific area.
03
How to read VIVO’s testing material
VIVO’s evidence and testing pages describe work performed in synthetic simulation and software-validation environments. Those materials are offered to explain VIVO’s development approach and what it is learning.
Unless VIVO expressly states otherwise in writing, that material does not establish real-world restaurant fit, driver behavior, field performance, traffic behavior, delivery economics, commercial viability, or a guarantee of any result. VIVO’s use of words such as “worked,” “supported,” or “indicated” is limited to the stated testing conditions and does not expand beyond them.
04
Contact forms and conversations
The restaurant, driver, and community-partner forms are a way to begin a conversation with VIVO. They are not applications, contracts, reservations, purchase orders, or binding proposals. VIVO is not required to respond to every submission or to act on any suggestion.
If you submit information, you represent that it is accurate to the best of your knowledge and that you have the right to share it. Please do not submit financial information, government identification, passwords, health information, confidential third-party information, or other sensitive information.
05
Acceptable use
You may use the site for lawful, ordinary informational purposes. You may not interfere with the site’s operation or security, attempt to gain unauthorized access, submit malicious code or automated spam, scrape the site in a way that creates unreasonable load, misrepresent your identity, or use the site in a way that violates applicable law or another person’s rights.
VIVO may limit or block access when reasonably necessary to protect the site, its visitors, VIVO, or others.
06
VIVO content and intellectual property
Unless otherwise stated, the VIVO name, logo, website design, written content, video, images, graphics, and other site materials are owned by VIVO or used with permission. They are protected by applicable intellectual-property laws.
You may view and share links to the site for personal or internal business purposes. You may not copy, modify, publish, distribute, sell, license, or create derivative works from site materials without VIVO’s prior written permission, except where applicable law allows it.
07
Third-party services and links
The site may include links to third-party websites, including a guided product-demo environment. These services are provided for convenience and may have their own terms and privacy policies. VIVO does not control and is not responsible for third-party content, availability, security, or practices.
Any access credentials supplied for a guided VIVO demo are for the intended walkthrough only. They do not grant a right to copy, reverse engineer, disrupt, or independently distribute the demo or its contents.
08
Disclaimers and limitation of liability
The site is provided on an “as is” and “as available” basis. VIVO makes no warranty that the site will be uninterrupted, secure, error-free, complete, or suitable for a particular purpose. VIVO may update, suspend, or discontinue all or part of the site at any time.
To the fullest extent permitted by applicable law, VIVO and its founders, collaborators, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the site. Nothing in these Terms limits liability that cannot be limited under applicable law.
09
Governing law and updates
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any legal proceeding related to these Terms or the site must be brought in a court with jurisdiction in Lee County, Florida, unless applicable law requires another venue.
VIVO may revise these Terms as the site and business develop. The effective date at the top of this page will show when the Terms were last revised. Your continued use of the site after a revision becomes effective means you accept the revised Terms.
